DPD - Shortage of Staff Not a New Issue




Well, all the hoopla over Chris Womack is done he kept his job he is safe for now. All of you are happy you have saved the day and the police department. Pat yourself on the back and be happy.  Before I go any further be sure to read the last paragraph.

I really thought that I helped the staff along as they did a good job on the meeting with the mayor but, I quickly found out never hold out the hand of friendship as you will draw back a nub. So, don’t be too happy.  Y'all been had. Take look back to the last quarter of 2013.  The police department was in a serious crisis then but, it was not brought to your attention. Matter of fact it was quietly put away. The Sentinel ran a post about it and the council knew however, with the holidays etc. it went to the back burner in a hurry.

What you don’t know see or know is since Chris Womack came into office there has been an exodus of folks from the department. Willingly, forced out, or run off.

The first to go were folks over 50. There were three of us. Yep I was in the first volley. Right now I will not go into detail but, I will tell you that you will see the reasons on my case and another in the future.  The three of us didn’t fit the profile of a super department.

Then the command staff slowly weeded out those who did not fit the description of what was wanted at the DPD. Young chiseled bodied officers.  These officers went to the gym every day and fit the superman or GI Joe description.  They were the oh-rah of  DPD or, as called affectionately “Law Dog”

Few ladies were hired during  the period.  To my knowledge  there are three female supervisors at the police department today.  One Captain, Sergeant, and a corporal the only one on the street is the corporal. The sergeant is in communications and the Captain is in the Command Staff.

In any case keeping officers under the current administration has been an issue.  What you don’t know is in the last three months of 2013 the department lost 12 officers. Go look it up. This Command Staff cant keep people. From October to November 12 officers walked out the door. Folks there is a problem and a pattern here. The FBI calls that a clue. There are serious personnel issues in this department. The command staff has been given too many chances. Y'all might want to pass this along. More to come....

DPD Film with Mayor Persons






Ya know, when the email first came out about a meeting with Mayor Persons and DPD troops I was really amazed at what I saw on Topix. In case you didn’t see the message here it is so we can reference to it during this blog:


 


“The Mayor met with the Police Department today and basically told Officers to piss off. He asked who live in Douglasville and 3 Officers raised their hands. He stated there are not enough of you living in the city to determine if I get re-elected... And then proceeded to tell Officers he isn't here to make friends. He got visibly mad when Officers asked him questions about the statistics he has about why Officers are leaving and got even madder when they questioned the Cities stupid purchases of certain properties! He stated the Police is the backbone of the City, but acknowledged if the pay study comes back saying they are under paid the City doesn't have the money to implement raises any time soon... Officers began to walk out of the meeting.”


 


I contacted a few folks and ask about it and discovered mixed signals. Most say Mayor Persons took some hard questions and he made some very sobering statements to the folks. No one in the meeting was happy.  No one viewed the meeting as being out of control.


 


I watched the video about 4 times. Mayor Persons came into the room and was prepared for the meeting as best as he could be. Evidently Chris Womack had a box set p for the officers to leave their questions to be answered at that meeting. Mayor Persons decided not to answer those instead having Chris Womack and Bill Osborne to look over them and deciding the course of action.


 


Knowing local and state government I understand that lot that would have to be addressed through committees, personnel, and the legal department. I can understand Mayor Persons stance on this as police can come up with a lot of questions that do indeed take a lot of research. The last thing you want to do in a meeting with mad police officer’s is making a mistake because, take they will eat you alive.


 


The question or statement of that the three officers could not re-elect him he was honest. However, he qualified his answer by saying the reason was each and every employee out there had to do a good job if they didn’t know elected official could get re-elected. I have heard that one more than once in my career. He told the officers more than one time how good of a job they were doing and if they didn’t he would be gone next time.


 


After seeing what happened at the meeting I believe a lot of feelings and emotions were at play by all of those there. From City Management, Command Staff, and officers all were concerned and have a right to be. Everyone in the room had an agenda. Some wanted the study and receive increases immediately, one wanted to know if they were making too much would they lose money, and health insurance coverage.


 


I believe that Mayor Persons was honest and sincere to the officers were the ones making the city look at a new pay plan. They recognize that it has to be done and is long overdue. The officers have brought to the front the highest cost of running a business and that is employees and benefits.


 


The plan we had was to be upgraded every year to keep quality employees and older employees on board. Your starting salary was the most important for the scale. Once hired on you knew where you would be for the next several years until top out. Once at top out you only got cost of living. That was an issue with some of the long timers they didn’t understand that a police officer should be making 80,000 per year for longevity – give me a break.


 


In any case been i have been there done that at the state level and city level. It will take at the minimum of a year to evaluate each employee’s job qualifications and then does the salary study of other cities. It must be understood by all the entire city will be evaluated as all salaries have to be updated.


 


You must hire an outside firm to conduct the study. I understand the frustration there but, if you want it done right this is the way it goes. The study cannot be instituted by the city for several reasons but, territorial disputes, favoritism, and fairness are a few. If you hang on it will be worth your trouble.


 


Wherein lays the problem. Are the citizens standing behind you now are willing to up the taxes on their property to finance salary increases for every employee? My guess is they will.  


 


There was an officer who asked Mayor Persons not being employee friendly. The mayor told him he liked to come up and ride and hang out sometimes with the guys but, the mayor was as blunt as Sheriff Lee was to a group of folks that walked out on him. He was not there to be their friend when it came down to the job he was their boss. If they weren’t happy they should leave.


 


I have heard that speech at every job I have had in law enforcement and if I were still there would be hearing it now. Mayor Persons handled bad news as best he could. However, there comes a time you draw a line in the sand. Either you get with the program and try to be a partner in fixing the problems or you make your decision.


 


A question came up about paying for street lights and other frivolous items. These Pink Elephants have been around for years losing money. Aint going away any time soon. You can start the finger pointing to the Administration of then Mayor Thompson. During his time the salaries were frozen and the city under took a large – no exorbitant land purchasing and grant acquisitions that are pulling the city under.


 


While at DPD I obtained 3 police officers on a COPS that they may or may not have had funds to continue their salaries. If you don’t keep those promises you will not receive another grant. You don’t want that relationship with the Department of Justice to erode. Besides it has my name on it. Seriously there are obligations that you may not be aware of that must be met.


 


I have heard stories from folks about not being treated right and disciplinary issues. You had your chance to talk and I know most of you wouldn’t because of the setting. I will bet you now that suggestion box will be your chance to make those comments. But, you can’t do this stuff without telling who you are. If that doesn’t work use the chain at City hall Mayor Persons made it clear many times he wanted to get to the root of the problems. Sounds to me like the door are open but, they are not going to act on an unsigned complaint. Get with the program.


 


Instead of dissecting the rest of the program it all comes down to this. In 37 years of public service I have heard the same speech – at times a little more flavorful from every supervisor Sheriff, Director, or Police Chief. As close as Joe Whisenant and I were friends at the end of the day he was the boss and I was an employee. I had worked for him at the Sheriff’s office in the 80’s and we had the same understanding then. You all have gotten the attention of the community, your command staff, city administration, and elected officials. I urge you to hang in there.

Disparage Treatment - What Reasoning Is Used In Making POST Reporting?


Sometimes officers do stupid things that turn into a huge mistake simply because they do not tell the truth when they screw up. There is a rule of law known as Brady material that requires an agency who has an officer who has lied to report that act to the district attorney’s office so that it can be made available to the defense in order to impeach the officer on the stand. It isn’t pretty when this happens. Lying can occur without thinking, spontaneous, or planed.  Command staff and internal investigators must determine if the action was an intention act that went to such a level that it caused severe discipline. 

 

In the previous blog I told you about disparage treatment at the Douglasville Police Department. Again before I left I was familiar with another case this one the officer lied and was fired. There is a twist to the case you will see in the end. Here is the synopsis from POST:

 

CASE NO. 010-724-03-07

 

CASE SUMMARY

 

This individual is Multi Certified (Jailer 10/15/03, Basic 07/13/05) and was employed by the most recent agency on 10/17/06. On 02/16/07 said officer resigned while under investigation for leaving the scene of an accident.
 

Said officer received a call to respond to a stolen vehicle. According to documentation in the file, the owner of the vehicle had the vehicle in question, blocked in a subdivision. While en route to the call, said officer lost control of his/her vehicle, striking a mailbox. Said officer failed to call in the accident or stay at the scene. Said officer drove back to the police department to change the flat tire.
 

While said officer was changing the tire, the owner (complainant) of the mailbox came to the police department. The complainant reported that his mailbox had been knocked down by a police car. According to the complainant, after hearing the loud noise, the complainant came out and saw his mailbox had been knocked down.


The complainant then saw a police car going toward the police station that appeared to have a flat tire. The complainant asked said officer if said officer had hit his. mailbox. Said officer told him that said officer did hit the mailbox while he/she was en route to a call. Said officer apologized for the damage and told the complainant that he/she planned to come back and tell the complainant after he/she completed the call.

 

According to the I.A. report, said officer told them. Major "I freaked and wanted to get the vehicle to the police department. "I know I left the scene of an accident." It is also noted in the report that said officer failed to report the incident to the supervisor before being confronted by the complainant. There was nothing else negative in said officer's file.

 

This investigator went to another agency where said officer had been employed prior to working for the most recent agency. The CEO of that agency told this investigator that said officer was a real good officer. According to the CEO, said officer wrote more tickets than all of the other officers in the department. Said officer voluntarily resigned from that agency to work for a larger department.

 

Said officer is not currently employed in law enforcement.

As you can see the officer was fired for lying to his superior officer about the true cause of the accident. He was fired and the firing prompt reported to POST. He was given 24 months probation if he was ever hired by a police department and given a public reprimand. 

 

If you read the previous blog what would POST done with the assault case had it been reported promptly? More than likely at least the sentence above but, more than likely they would have taken his certification for a period of time. Do you see the disparagement that officers are seeing? There are others out there.

 

Now for the twist within the past year DPD re-hired this officer. He had been charged and convicted of lying and he comes back to Douglasville Police Department. 


Every officer knew of the accident and the lie. Supervisors were asked if they had a problem with the man coming back. What would you say? The decision had been made the Command Staff was going to hire him anyway I would have done what I did but, shouldn't have done, the last five I was there yes sir what ever you want and let it go.


I gave you the description of Brady now what would have happened if he was the first officer on the scene or, involved in a critical incident and the only witness? There would be a big problem in there the DA would have a hard time getting the case off the ground. His previous cases could have been affected also. Fortunately, I understand the officer has resigned within the past few months let us hope nothing important is in jeopardy.

 

Running a police department is not like running a day camp. You have rules, regulations, and laws you must abide by. You cannot ignore POST rules as if they weren’t there simply because, you want to avoid having an officer off the road for months. No law enforcement agency or its officers are above the law.

Disparage Treatment – The Real Issue at DPD


If any of you have had contact with officers of the police department that have left or, are leaving you will have heard that they are tired of the disparage treatment by management.  I have been gone four years because of continual harassment and mistreatment. I made good decisions but, when the mistreatment started I could not do anything right. I finally made err in judgment. I am paying dearly for it with my disease. I am also still in litigation with the City I will go no further. I know the stress these guys are under and I am not surprised the Governor has not stepped in and filled the streets with State Patrol and GBI agents.

 

At the time of this writing the department is pulling detectives from their duties to work the streets. This leaves investigations at a standstill. Your burglary that may have been solved will be put on the in-active list because that detective could not do his job. Officers are forced to work overtime which causes even more stress and fatigue. To top it off an ass chewing by one of the command staff daily is common. The command staff is on the third floor. I have been told by more than one current and numerous former employees that no one is allowed on the third floor for one reason alone and that is punishment. The Ivory tower effect.

 

I have taught classes in many states and cities on internal affairs. The biggest complaint was not the IA end of it but, the punishment was not consistent with the violation. I would have to say the following that occurred at Douglasville – one of many that I will share tops the most outrageous I have ever heard of in any state, city, or county. Not only the incident that happened but, the cover-up afterwards.

 

Georgia Peace Officers Standards  and Training  Council licenses officers and determines their fitness for duty.  If an officer is demoted the Department and the officer are bound by POST rules which are law. The following comes from the investigative file I obtained from (POST):

 

In or about February of 2010, the CEO ordered an internal investigation after it was brought to his attention the officer had violated the Use of Force policy on two separate occasions.

On or about 12/14/09, officers responded to a Burglary in progress. The offender was

resisting as the officers were attempting to handcuff him. The offender was lying face down on the floor with his hands underneath him. Four officers were on top of the offender but he was still not complying to their commands. This officer came up and kicked the offender in the face.

The internal affairs investigators findings to this allegation were sustained.

On or about 01/29/10, the officer allegedly used excessive force on an intoxicated individual as the officer was attempting to place the individual in the back of a patrol car. The individual had been fighting with another officer that resulted in the individual bleeding inside his mouth. The individual spit on the officer and the officer allegedly slapped the individual in the face with an open hand. This allegation was not sustained.

The officer also was found to have violated policy by allowing an individual to be a ride­ along with the officer on several occasions without having the individual sign the mandatory waiver form. The officer did not deny this allegation and where he/she was asked why, the officer responded by saying "Honestly, Laziness probably.

On or about 02/23/10, the officer was suspended for a period of 80 hours without pay, demoted from lieutenant to detective, placed on probation for six months, received a Written Reprimand, and ordered to attend Use Of Force Training for Excessive Use Of Force and Dereliction Of Duty.

 

The issue here is that the command staff failed to report this to the District Attorney David McDade. You don’t kick a man in the face when four officers are holding him down. That was substantiated. The slapping of the other officer was not. It is an issue the DA had to look into. I contacted McDade left it with him I do not know the results and McDade and have not discussed it as it was left in his hands. The officer is still working and I must say he is a great guy.

 

However, I continued to wait to see if they would ever report the incident to POST. Finally, I reported it to POST in early 2013. There was an investigation done and the council ruled that the department punishment was sufficient. The question is what else could they do four years later as a colleague at POST and I discussed. How do you go back and punish someone four years later. The statues of limitations were basically up.

 

I have fired officers for less than that at the State. If you hit an inmate being held down by four officers you walked out the door in cuffs. The issue is DPD has fired officers for less than that. They are quiet proud of the fact and let it be known in the law enforcement community. They have also reported those officers to POST. The problem is - this is not the only one stand by for more

DPD - Deserting the Ship - Follow-up with Chief Womack

I spoke with the Chief Womack yesterday and asked for a sit down and work this thing out. He began by talking about the vehicles. This morning I received an email from him and the following is his response verbatim from the email he sent me
 “About a year ago (paperwork from the minutes show this was completed in 2014) I did buy a 2013 suburban in line would the same type of vehicle your neighbor (Chief Whisenant) bought repeatedly. and did not pay anywhere close to 60k for it. As you know we were hit with two significant ice and snow events in the winter. Unlike my predecessor in an attempt to save money I had not been purchasing 4 wheel drive vehicles. when the first one hi I worked about 48 hours straight. delivering children home who have been trapped at school in my personal 92 model four wheel drive blazer. unfortunately for myself during this time, a curb got one of my tires and only way home after almost 3 days not being home the transmission gave out. since I made the decision to drop my personal car felt it was my responsibility to pay the almost $800 and repair out of my pocket. Then just a few weeks later we were hit with a second storm and I was stuck again luckily this time the old blazer held up. record graph had been driving had almost 100,000 miles on it and was having issues. I found a dealer who gave us a great trade in on an 08  suburban with high miles and got the 2012 Jeep 4 wheel drive. I passed the 13 suburban down to Graff.”
Now I have no way of confirming this as he stated this happened over a  year ago. I know I am brain damaged but, I don’t recall two ice storms in 2013 when he says he bought the trucks. So, y’all give me some time to research and see it there were four of these things bought. Two this year and two last year.

In the explanation that the Chief gave me this morning he issued this promise “Nonetheless after years later and you have talked so much trash about me that there are no facts to back up what so ever I still made time to call you. Then this morning you send a another letter threatening that you will be forced to plow forward. I guess I'm just going to have to let this one go until you to plow forward....I have also decided did I'm turning this over to my attorney and move forward myself.” 
Well folks, I have tried to talk with the Chief several times about a one on one session here at my home on my back porch. It is hard for me to do steps and there are no hidden mikes or surveillance here unless he sends someone into my property to trespass and watch things. None the less I wanted to settle these matters prior to suing him two times with no success. Now I have to go on with the next step. He will not do it I have no idea why. I talked with him personally two times yesterday and he was to get back with me - never returned a call.  So, unless someone intercedes we will both be plowing.
If anyone of you out there can explain why a man, a cop, and a Marine will not honor an agreement he made to me the day I resigned tell me. A man's word is his word. He does not deny he made the  agreement that was conceded to by the city in Douglas County Superior Court. The City of Douglasville claims he did not have the authority to make that agreement.   I do know Chris promised me that while Deputy Chief Sparks was on the phone with personnel Director Fred Perry. Now what would you believe?If you do business with anyone at the city get it in writing. They are hiding behind qualified immunity. Basically it says they can promise you anything knowing they are not going to honor it the minute you walk out the door. In the old days we called that a lie.
Every council person I have talked with says they want me to receive my retired ID. They have had long discussions about it and want it done but, they can’t order Womack to do it. Who in the hell runs the city? The chief, mayor, city attorney, or city manager.
I got out of their hair because they wanted me gone. I did not know at the time the reason I have Spinal Cerebella Ataxia was from the  department. You would think they would have the compassion to give terminally ill man who gave his all to Douglasville and Douglas County 22 years of his life a simple ID. Give me your thought a and maybe someone on the council will read them.

City Pay Woes - It Isn't All Chris Womack's Fault









No matter how much anyone wants to blame the current pay crisis on Chris Womack you can’t do it.  It has been in the works for years. These things happen to government's in cycles it is just time for Douglasville to catch up again.





I went to work for Douglasville Police Department in 1997. The mayor at the time was Charlie Camp who was beloved by most every city employee there. I had left a state job making substantially more money than I could be paid here.





Why did I leave??? I had been with the Department of Youth Services for nearly 15 years. I was the agent in charge of Internal Affairs working directly for the Assistant Director of Investigations. I had a take home car and I traveled all over the State of Georgia and surrounding states on cases. One case led me to Washington DC where I spent some time with the DC police. Sounds good right?





I was tired and home sick. I wanted to come back to Douglas County and finish up my career here. That didn’t work out like I planned but, that is for another day.  So, I talked with Joe and Charlie. Both were made concessions that made it possible for me to come back home. After talking and praying Linda and I decided to take the pay cut and do it.  Taking all things into consideration I was not hurt too bad.





 


In 1998 all employees were given a 6% increase along with a $1000 dollar bonus for staying for not using sick leave.  Folks,  that was a good increase I don’t care who you worked for.  The most I ever received at the State was 4%.  As a side note the bonus was discontinued some time later and I was a supervisor. Employees told me they earned their sick leave and they would take it. So, folks who don’t say incentives don’t work?


 


From 1997 until 1999 I went from the starting salary and two promotions to close to where I was when I left the State. However, we were losing employees and dropping standards to hire new officers. We were at rock bottom in the metro Atlanta area in starting salary. Furthermore, there was no top out salary available. Employees had no idea when they would reach the salary cap.





At that time Councilman Doug Lequire took the bull by the horns and did a complete study of every job in city government and came up with a classification for each one. Then he did the what most companies did at the time was giving each classification a step increase to a top out level in pay.  The State of Georgia began the same practice a few years after I left with guaranteed step increases.





The intent was for every employee to know where they would be in the future and they would have to work for that increase. If they didn’t make the grade they stayed at the same salary. In addition the traditional summer picnic, and Christmas party where the employee received the $1000 bonus for not taking sick leave, and other items were given to the employee.





The council voted on the plan and it was enacted. All city employees received a significant increase in salary.  My increase was over $5000.00.  The starting pay for a patrolman was increased to well above any department in the state. We began keeping folks and hiring quality people.





Within two years the entire system was thrown completely out the door by the council due to its cost.  The picnics, Christmas parties, bonus, and other incentives were eventually taken from every employee. Since that time the starting salary has been stagnant. 





There are many issues as I see it. The council has not increased taxes relying on sales tax, fines (money maker), fees, and other assorted ways and means of coming up with income.  The Pink Elephant’s such as an elaborate Police Department (go see for yourself), Conference Center, and a golf course that are losers draining income and resources.





I do have an issue with the police department being rank or, supervision heavy. I have voiced this before and will continue to. You do not need a lieutenant, sergeant, and corporal on a shift to supervise four officers. It is only a way of giving raises to employees. It is just not right.  So, I believe you get the idea.





But, when you come right down to the cash for police officers and city employees raises, don’t blame it all on Chris Womack, there is room for all to share.

DPD - Deserting the Ship

Having had legal issues with the City of Douglasville Police Department over a mistake I made and a resignation contract the city refused to honor limits me in what I intend to say here but, it is high time someone did. I will tell you I was wrong and deserved discipline the rest remains in court.
Having worked in the field of internal investigations, serving as an advisor to the IACP and Federal ...agencies on small to mid-size police departments and hired to assist and conduct audits of police departments around the country we have a problem here.
During my 37 years and the my entire time as an officer pay is not the main reason officers leave police departments. That is the CEO’s excuse. Cops love their jobs. We had an old saying “I can’t believe they pay me to do this”. Officers love the communities they work in and the people there. You all need to hear the rest of the story by demanding an audit of your police department.
The down fall of most departments low moral due to favoritism, unequal discipline, failing to communicate to the officers on daily actives that affect the officers lives. Expenditures such as 60,000 (give or take) Suburban for the chief who decided he didn’t want it and bought a 50,000 (give or take I have the OR here) Jeep Cherokee because he wanted in a matter of months. I have been told by an outside agency tell me where the Command staff parks looks like the White House protection vehicles.
Officers are human beings they are not soldiers that are to be ordered about. They are educated and deserve explanations as to why they are completing a job in a way that may not be correct or is correct but, need reassuring they will be okay in this litigations society. They are in danger as they have no experience. There will be a serious incident sooner or later.
Having spoken with officers who have left what once was a great police department morale is at an all-time low. I have been told there are evenings there are only 3 officers on duty at night. Now I beg to question why is the city balking at paying for fire services when the Sheriff is kind enough to pick up calls for the Police?
I can and will go on within the next few weeks with my new blog. Citizens take a look. Check the radio logs at 911 and see how many folks are on the road. Check with Peace Officers and Training and you will see you have one of the youngest departments in the state of Georgia. As the great Earl Lee said get out there get active and get it done. You the public need to make a change.
Give me your thoughts and maybe someone on the council will read them. I really care for these kids and don’t want them hurt.

They are in danger as they have no experience. There will be a serious incident sooner or later.

Having spoken with officers who have left what once was a great police department morale is at an all-time low. I have been told there are evenings there are only 3 officers on duty at night. Now I beg to question why is the city balking at paying for fire services when the Sheriff is kind enough to pick up calls for the Police? 

Citizens take a look. Check the radio logs at 911 and see how many folks are on the road. Check with Peace Officers and Training and you will see you have one of the youngest departments in the state of Georgia. As the great Earl Lee said get out there get active and get it done. You the public need to make a change.
Give me your thoughts and maybe someone on the council will read them. I really care for these kids and don’t want them hurt.
